Foreign trade in weapons, military equipment and special purpose goods

The conditions and procedures for the export of weapons, military equipment and special purpose goods are prescribed by the Law on Control of Foreign Trade in Weapons, Military Equipment and Special Purpose Goods ("Official Gazette of BiH" No. 53/16) and the Instruction on the conditions and procedure for issuing documents for foreign trade trafficking of weapons, military equipment and special purpose goods ("Official Gazette of BiH" No. 69/17).

All persons engaged in foreign trade in goods and services listed in the Common List of Weapons and Military Equipment and List of Special Purpose Goods are obliged to submit to the Ministry a request for registration in the Register. The registration procedure is prescribed by the Regulation on keeping a Register of persons in foreign trade in weapons, military equipment and special purpose goods ("Official Gazette of BiH", No. 68/17)

The Ministry updates and publishes the Common List of Weapons and Military Equipment ("Official Gazette of BiH" No. 6/17). This List is a translation of the Common Military List of the European Union adopted by the Council on 9 February 2015 (equipment included in the Common Position of the Council 2008/944/CFSP on the establishment of common rules for the control of exports of military technology and equipment).

The Ministry, in consultation with the competent state, entity or cantonal ministries and bodies of the Brčko District of Bosnia and Herzegovina, shall adopt and publish in the Official Gazette the List of Special Purpose Goods. Special purpose goods are non-military assets for commercial purposes which are not listed on the Common List of Weapons and Military Equipment or on the List of Dual-Use Goods ("Official Gazette of BiH" No. 25/17).

The Ministry issues the following documents:

a)      License for export, import and brokering of weapons and military equipment listed in the Common Military List and Military Equipment, License for export of special purpose goods specified in the List of Special Purpose Goods, and License for export and import of services related to weapons and military equipment. Licenses may be: individual licenses and global licenses,

b)      Import Licence for Special Purpose Goods

c)      International Import Certificate

d)      End User Certificate, and

e)      Receipt of goods.
